My 23 year old daughter got killed by a driver, charged at the accident with DUI and manslaughter.

My  daughter got killed by a driver, charged at the accident with DUI and manslaughter, 2 days after her 23rd.; birthday.  AFTER 16 MONTH  the prosecutor  asked me to send him a letter for the judge for the next disposition conference at the Superior Court on Wednesday July 26, 2017 at 1:30PM, courtroom 12 Ventura. I don’t get it, he asked to write a letter about you how beautiful and good you are. I am disgusted, how can a letter change facts, and the only other fact is you will never be with us again, and I mean “never” and the prosecutor needs me to tell everybody what a nice person you are just to get a conviction for your murderer, what about the facts.

Below is the e-mail with the attached letter I wrote to him to give to the Judge. And I want the whole world to know how I feel, there are no secrets.

To whom it may concern:

Dear Sir/Madam

My Name is Walter Unger and I am the Father of Nadya Simone Unger who died in an accident on 4/21/2016, 2 days after her 23rd. birthday. I am an Austrian citizen and have a greencard. In December 2016 Nadya became an European Union (Austrian) citizen, providing her dual citizenship.

I was a single father and Nadya lived with me at least half her life in the desert in Three Points, Tucson Arizona. She was the most beautiful, positive, confident, smart, respectful and positive kid a father could wish for. She did not have a negative thought in her mind, everything was possible. That’s why she had so many friends, everybody loved her and there were about 135 people at her funeral service. Many of her friends from Arizona could not make it, otherwise there would have been another 50 people there. She loved animals and when she was 21 she started her own dog grooming business in Camarillo CA. “Bark Bath & Beyond” 4928 Verdugo Way, Camarillo, CA 93012. All her customers loved her, she had a special way with any animal in this world.

On April 21, 2016 she rode as a passenger on a motor bike with a friend of hers (Garrett Vongunten). Mr. Vongunten had no drivers license, he also had another bike accident before and a DUI charge. Vongunten said on the police report he did not see the train which was traveling at normal speed. He also did not see all the stopped cars who were waiting for the train to pass while the red light was flashing and the arm was down. Obviously he was under the influence and this was verified by the police at the police report. That’s how he killed my beautiful daughter Nadya who will never be with us again.

Vongunten’s friends mentioned on Face Book this day of the accident that he was drinking and doing drugs before he picked up Nadya and when the police came to the accident my daughter was dead and he was in in a coma. The police charged him with felony DUI but could not hold him because he was unconscious. I had to wait for the police report for 8 months, and when I finally got it the charges were FELONY DUI and MANSLAUGHTER.

When the District Attorney finally contact me I was told they will drop the DUI charge because they think they cannot win the case and they will only prosecute cases when they are 100% sure they win.

Now about 3 month later and 3 continuations of a disposition conference I was told by Mr. Taylor Waters that they try to make a deal with the defendants Attorney and the deal they try to make could result in an outcome of misdemeanor, 1 year County Jail or maybe 2 years federal prison. When I was totally surprised about the misdemeanor the District attorney (Taylor Waters) told me he will try not to let it be a misdemeanor. But he said it is totally out of his hands, it is up to the judge, he told me the judge send out the papers to the defendant’s attorney and there is nothing he can do about it, it’s not up to him. Later on I found that Mr. Taylor lied to me, I was naïve but found out and was told that the prosecutor makes the deals with the defendants attorneys and not the judge. The judge will look at it after and either approves it or not.

When I was asked by Mr. Taylor Waters to write a letter about Nadya how beautiful and good she is I was disgusted, how can a letter change facts and another fact is my daughter Nadya will never be with us again, and I mean “never” and the prosecutor needs me to tell everybody what a nice person Nadya is just to get a conviction for her murderer, what about the facts.

This is the way I feel, I miss my baby soo much and the last thing I need is playing a game with facts, the fact is the fact and I thought the State will at least try to get a fair conviction for Nadya.

I will copy this letter to Nadya’s mother, Nadya’s sister, the News papers and I also will get it out on social media. I have nothing to hide and I found out it does not matter what I do anyhow, Nadya’s sister and I collected over 500 signatures for “ Justice for Nadya” for the district attorney but nobody cares, it was just a waste of time, in my opinion the district attorney probably never looked at it.
